General terms and conditions (AGB) or conditions for participating in the photo mosaic for Schoenstatt's centenary 2014

1. Contracting parties

1.1 These general terms and conditions regulate and stipulate the legal relationship between the Matri Ecclesiae e.V (in what follows referred to as the Association) and the natural person or persons registered as user(s) of the internet platform www.mta-schoenstatt.de (in what follows referred to as the internet page). The validity of any other terms and conditions of the user are herewith excluded. These general terms and conditions can be downloaded at

6. Applicable law and place of jurisdiction

6.1 German law applies exclusively.

6.2 The place of jurisdiction, insofar as this can be agreed upon, is Simmern, Westerwald, Germany.

7. Closing provisions

7.1 Any alterations and additions to these general terms and condition have to be made in writing. The requirement of the written form also applies to their suspension. Individually negotiated terms, whether in written or oral form, are null and void.

7.2 If one or more provisions become null and void, the effectiveness of the other provisions remains unaffected. If individual provisions become null and void, the parties to this agree that they will be replaced by a regulation that most efficiently meets the intended purpose. This also applies if these general terms and conditions in fact contain a regulatory gap.

7.3 The headings given to the general terms and conditions and the data protection regulations only serve the purpose of explanation.

7.4 In case of a dispute, the original German text has to be seen as the legal frame of reference.

2. Purpose of donations

The website mta-schoenstatt.de offers users the possibility to upload one or more photos to be inserted into a photo mosaic following a donation.

3. Procedures and details for participation

3.1 In order to take part in the donation project it is necessary for the user to register online with his or her email address and password.

3.2 Through registering, the donor provides personal data to an input screen and thus applies to become a donor.

3.3 The user accepts the obligation to provide truthful and complete information when registering online. The Association reserves the right to require the agreement of parents in the case of minors.

3.4 The operator decides at his own discretion whether a donation will be accepted, or not, and reserves the right to examine the information provided by a donor at any time.

4. Donations

Donations will be passed on to the Association.

5. Right of cancellation

The cancellation of a donation or the contribution of a photo to the mosaic are subject to legal provisions. The complete wording of the so-called cancellation policy for this website can be found below.
